Asylum Determination Process

A person is not officially described as a refugee in the UK until they have been awarded refugee status as a result of the determination of their case. However, technically speaking, the state does not make someone a refugee; rather it recognises them to be one by declaring that their circumstances meet the criteria of Article 1(A) of the Refugee Convention.

This briefing, wrote by ICAR to assist the work of the Independent Asylum Commission (IAC), summarise key issues of quality, accuracy and consistency in the Home Office decision making process on asylum claims in the UK.
